These Terms & Conditions (“Terms”) apply to your access to and use of sdleakdetectionpros.com (the “Site”) and to the leak detection, repair, and related services (the “Services”) provided by San Diego Leak Detection Pros (“we,” “us,” or “our”). By accessing the Site, requesting an estimate, or engaging us for Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.
1. Eligibility and Authority
You represent that you are at least 18 years of age and that you have the legal authority to enter into these Terms. If you are using the Site or Services on behalf of a business or another person, you represent that you are authorized to bind that party to these Terms.
2. Our Services
We provide non-invasive leak detection and repair services for residential and commercial properties, including slab, water, gas, pipe, pool, drain, and foundation leaks. The scope, method, and outcome of any Service will be described in your estimate, work order, or invoice. Leak detection is an investigative process: while we use professional-grade acoustic, electronic, thermal, and pressure testing equipment and experienced technicians, we cannot guarantee that every leak will be located, particularly where leaks are intermittent, concealed, or affected by conditions beyond our control.
3. Estimates and Pricing
- Estimates are based on the information available at the time and may be provided verbally or in writing.
- Estimates are valid for the period stated and may be revised if site conditions differ from those observed or described, or if additional work is required.
- Any additional work will be explained and, where practicable, authorized by you before it is performed.
- All prices are in U.S. dollars and, unless stated otherwise, do not include applicable taxes, permits, or third-party fees.
4. Scheduling and Property Access
You agree to provide safe and reasonable access to the property, utilities, and any areas needed to perform the Services, and to disclose any known hazards. You or your authorized representative should be available, or have made arrangements for access, during the scheduled appointment. Delays caused by lack of access or undisclosed conditions may result in additional charges or rescheduling.
5. Payment Terms
- Payment is due upon completion of the Services unless other arrangements are agreed to in writing.
- We accept the payment methods disclosed at the time of service. Returned or dishonored payments may incur fees permitted by law.
- For larger projects, a deposit or progress payments may be required as stated in your estimate or work order.
- Overdue balances may accrue interest or collection costs to the extent permitted by applicable law.
6. Cancellations and Rescheduling
We ask that you provide reasonable notice if you need to cancel or reschedule an appointment. Missed appointments or late cancellations may be subject to a trip or service fee where permitted by law. We may reschedule an appointment due to weather, emergencies, or other circumstances beyond our reasonable control.
7. Warranty and Guarantee
We stand behind our workmanship. Unless otherwise stated in your invoice or work order, we warrant our repair workmanship for a period of 30 days from the date of service. This warranty covers defects in our workmanship under normal use and does not cover:
- New, separate, or unrelated leaks or failures that arise after the service;
- Damage caused by third parties, misuse, neglect, accidents, acts of nature, or movement or settling of the property;
- Pre-existing damage to the property, including walls, flooring, cabinets, landscaping, or fixtures;
- Parts, materials, or equipment supplied by the manufacturer or a third party, which may carry their own warranties.
Detection services identify suspected leak locations based on the conditions present at the time of inspection and are not a guarantee that all leaks have been found or repaired.
8. Disclaimer of Warranties
Except as expressly stated in these Terms, the Site and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the fullest extent permitted by law, San Diego Leak Detection Pros and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Site or the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the total amount you paid to us for the specific Service giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless San Diego Leak Detection Pros and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your violation of these Terms, your misuse of the Site or Services, or your violation of any law or the rights of a third party.
11. Intellectual Property
The Site and its contents, including text, graphics, logos, images, and software, are owned by or licensed to San Diego Leak Detection Pros and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from the Site without our prior written permission.
12. Third-Party Content and Links
The Site may contain links to third-party websites or content. We do not control and are not responsible for third-party websites or content, and links do not imply endorsement. Your use of third-party sites is at your own risk and subject to their terms.
13. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and post the revised Terms on the Site. Your continued use of the Site or Services after an update constitutes acceptance of the revised Terms.
15. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.
